OpenAI has claimed recently that the Chinese AI Large Language Model (LLM) that shook the market DeepSeek may have used its data from its own model to set up its own AI chatbot.
OpenAI – DeepSeek Distillation?
According to an OpenAI spokesperson who sent a statement to NBC News, DeepSeek may have used a tactic known as distillation to catch up. Distillation is when an LLM is trained using data generated by another LLM.
“We are aware of and reviewing indications that DeepSeek may have inappropriately distilled our models, and will share information as we know more,” the spokesperson said.
The tactic is common in the industry but is often prohibited from the terms of service of LLMs, for obvious reasons.

ChatGPT, OpenAI’s LLM, was also accused of inappropriately using content it didn’t have rights to. This has been the subject for multiple lawsuits.
The company’s spokesperson mentioned that it is working closely with the US government to protect its technology.
“We take aggressive, proactive countermeasures to protect our technology and will continue working closely with the U.S. government to protect the most capable models being built here,” the spokesperson said.
As of writing this, DeepSeek has yet to comment on the allegation. We’ll update this if a statement is made by the Chinese company.
