Report: Apple Accused of Infringing Patents, Suspension of Apple Watch Imports May Follow

Apple has been accused and sued by Masimo last 2020 for possible patent infringement. Currently, the court found the former guilty resulting in the United States International Trade Commission (USITC) considering banning the import of the company’s smartwatches (Series 6 and up).

The Cupertino-based company partnered up with Masimo and signed the latter’s chief medical officer. 

However, despite that, Masimo’s CEO stated that the meeting was arranged with the purpose of poaching employees and gaining information/details regarding Masimo’s products.

This then resulted in Masimo suing the American company in 2020 for infringing 10 patents and requesting a ban on Apple Watches in the U.S.

As of now, the USITC is closely studying Apple’s implementation of the pulse oximeter and its application and deciding if the tech company used Masimo’s trade secrets to develop the said tech.

Also, the USITC is a separate entity from the court and may come to a different conclusion after its own investigation.
